Terms and Conditions

The offer and sale of the products through the website www.caffegiusto.it and Customer Service number +39 0827 42750 are governed by the following General Conditions of Sale.

The General Conditions of Sale are formulated in accordance with the rules on contracts concluded outside the business premises and in particular by the provisions of D. Lgs. 6 September 2005, n. 206 (Consumer Code).

 

Contract Parts

The parties to the contract are as follows:

– Caffè Giusto: Call Me Coffee Srl, based in Nusco, S.P. 59, Register of Companies of the Chamber of Commerce of Avellino, Tax Code and VAT Number 13192011008.

– Customer: the final consumer or the natural person acting for purposes unrelated to his business and professional activity, identified through the website www.caffegiusto.it or by phone call, who has concluded an order accepted by Caffè Giusto.

Application and modification of the General Sales Condition

After receiving an order, Caffè Giusto will automatically send a confirmation of receipt by e-mail, in which all the details of an order will be summarized. Upon receipt of an order, Caffè Giusto will verify the availability of the product ordered, and only after this verification will communicate its acceptance of an order and the shipment of the product.

If Caffè Giusto is not able to fulfill an order received, it will promptly notify the customer.

It excludes any right of the customer to compensation or compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/ or things caused by the non-acceptance of an order.

 

Payments

Caffè Giusto accepts payment only through the following systems:

– Paypal: online payment system that allows any company or consumer with an email address to send and receive payments, upon registration. Payment is made through the Paypal payment platform.

– Cash on delivery (+5%): payment will be made in cash to the express courier at the time of delivery with a surcharge of 5% to the cashier.

 

Product Delivery

Shipments and deliveries of products can be made exclusively in the territories of the Italian Republic, S. Marino, and Vatican City. Caffè Giusto will ship the products purchased exclusively to the destination specified in an order. We do not accept shipments to Mailboxes.

Caffè Giusto will ship the products ordered by the customer, by courier, to the address indicated by the same, indicatively within 24/48 working hours from the acceptance of the order. Delivery usually takes place within 4 working days. The delivery times are approximate.

Delivery costs are invoiced on the basis of the rates indicated on the site or communicated by the Customer Service on the date on which an order was sent.

The consignee of the goods shall be responsible for paying the taxes and customs charges provided for by the legislation in force in the territory of the destination of the products.

The courier is responsible for the delivery. Caffè Giusto undertakes to collect any reports of failed or delayed delivery of the products through the Customer Service and, where appropriate, to assist the Customer to protect their rights as per law.

 

Acceptance of the product by the customer

Any damage to the packaging and/or the product or the mismatch of the number of packages or indications must be immediately contested by adding specific indication on the delivery document. By signing the courier document, the Customer certifies the real external integrity of the product and the conformity of the delivery.

Any problems concerning the actual physical integrity, correspondence or completeness of the products received must be reported within 10 working days of delivery by sending an email to the commercial address@caffegiusto.itor by calling +39 0827 42750.

 

Billing Terms

The invoice will be issued for each order of the private customer who has entered his tax code, and for each order of the professional customer or company with p. VAT. To issue the invoice, the information provided by the Customer at the time of an order shall be deemed authentic. No change in the invoice will be possible after the issue of the same. When ordering, it is necessary to indicate whether the shipping address is different from the billing address. If the private customer chooses not to enter their tax code, or the professional customer or company its p. VAT, Caffè Giusto will not issue an invoice or certify the payment by issuing a receipt or receipt (art. 22, paragraph 1 DPR 633/72 and Art. 2, lett. oo) DPR 696/96).

 

Complaints and return (RMA)

In execution of the order of D. Lgs. 21 February 2014, n.21 of implementation of Directive 2011/83/EU on consumer rights, the customer can return the product purchased and get the refund of the amount of purchase actually paid.

The right of withdrawal can be exercised within 14 days of receipt of the product in the following manner:

  1. Upon expiry of the said period, the Customer shall either send a registered letter with acknowledgment of receipt to Caffè Giusto or make another explicit statement to that effect. The communication can be sent, within the same period, by telegram or e-mail to commercial@caffegiusto.it , or telephone communication to the Customer Service at +39 0827 42750 (for the withdrawal form type click here).

If it is no longer in its possession, the Customer must contact Customer Care at no. +39 0827 42750 or at the commercial email address@caffegiusto.itto obtain the transport document number in order to report it in the withdrawal form.

  1. The Customer is then contacted by Caffè Giusto to take charge of the return.

The return of the product must take place within 14 days from the date of receipt of the notice of withdrawal.

The refund of the price paid for the purchase of the product includes shipping costs.

Where the value of the products has decreased due to handling other than that necessary to establish the nature, characteristics and functioning of the products, (for example, products which are damaged, not packed regularly or completely, or in which certain parts, such as components, elements, accessories, packaging materials, boxes, documentation and/or other objects, are missing or have been damaged), Caffè Giusto will refund to the customer the purchase amount less the value of the said decrease. If the Customer sends back products beyond the above term or in the case of open and/or partially used products that do not lend themselves to being returned, the right of withdrawal does not apply and Caffè Giusto will return to the customer the goods purchased by charging the same shipping costs.

 

Guarantee

All products, other than food products, sold by Caffè Giusto are covered by the manufacturer’s conventional warranty and the 24-month warranty for defects of conformity according to Legislative Decree no. 24/2002 and s.m. and Articles 130 and 132 of Legislative Decree no. 206/2005. To benefit from the warranty service, the customer must keep the invoice, or, where it does not exist, the transport document.

If the purchased product is found to have manufacturing defects and/ or have been damaged during transport, the customer may request the replacement of the same within the mandatory period of 10 days from receipt by telegram, or e-mail to the following commercial address@caffegiusto.it, or telephone communication to Customer Service on +39 0827 42750. The Customer is also required to return the defective or damaged product in its original packaging intact in all its parts.

In case of replacement of the product, the shipping costs for the return are charged to Caffè Giusto. Caffè Giusto will then replace the product with an identical or, in case of exhaustion of stocks and subject to agreement with the customer, with one of equivalent value.

 

Law and jurisdiction applicable

The sale of products and/or services takes place in the territory of the Italian State and is subject to the laws in force in the Italian Republic. Jurisdiction for the resolution of any dispute will be the one provided for by the Italian legislation in force at the time of the conclusion of the contract.

This tool can be used by the European Customer for the out-of-court resolution of any dispute arising from the purchase of Products on www.caffegiusto.it. Caffè Giusto is available to answer any questions sent by email to the commercial address@caffegiusto.it.
